Legislature’s GOP leaders take Whitmer emergency powers case to MI Supreme Court

The Legislature’s Republican leaders have taken their challenge to Governor Gretchen Whitmer’s use of her emergency powers to the state Supreme Court.

Senate Majority Leader Mike Shirkey (R-Clarklake) and House Speaker Lee Chatfield (R-Levering) want the justices to reverse lower courts that upheld Whitmer’s authority. The challenge says Whitmer’s continued use of emergency authority to enact COVID-19 restrictions violates separation of powers and infringes on the Legislature’s right to enact laws.

The justices of the Supreme Court now have to decide whether to take case -- or refuse to hear the challenge and let the lower court decision stand.
